Sales contract
I, Cynthia White, the breeder / owner of the said puppy (described below), hereafter "Breeder", do enter into an agreement with _________________________________ hereafter "Buyer" for the purpose of transferring ownership of the said puppy. The said puppy is a purebred MINIATURE Australian Shepherd __MALE_, sired by ________________________________________, out of ______________________________________________. The puppy is a ____________ in color. the puppy's date of birth is _____________. The breeder will transfer ownership of the said puppy if the sum of _______ to be paid in full before the buyer takes possession of the puppy.
GENERAL PROVISIONS:
The breeder reserves the right to refuse sale of any puppy/dog to anyone.
This sales contract is non-transferable.
All puppies are sold as pet quality and are warranted only for the purpose of being a companion animal. The puppy will be sold with limited registration. No breeding rights will be given unless discussed with the breeder prior to the sale of the puppy. The cost of full registration with breeding rights will be equal to the price of the puppy and is paid at the time of purchase. No guarantee is provided by the breeder for the purpose of breeding or showing the puppy.
Breeder does not guarantee the size of the puppy at maturity. Breeder will give an estimated mature height and weight based on the size of the parents and their backgrounds.
The breeder will supply up to date health records and a health certificate to the buyer at the time of transfer of the puppy.
Registration papers for the Australian Shepherds (or Miniature Australian Shepherds) will be provided as part of this agreement and will be provided to the buyer upon full payment of the puppy. These papers will be with limited breeding rights.
BUYER RESPONSIBILITIES:
The buyer agrees that the puppy will live with the buyer, will have adequate exercise, nutritious food (currently on Life's Abundance dog food), vitamins (currently on NuVet Plus vitamins), and necessary healthcare provided by a licensed veterinarian. This will include a yearly health examination and appropriate vaccinations.
The buyer agrees to keep the puppy on heartworm preventative medication, this will be started by the breeder.
The buyer agrees to spay / neuter the puppy before it's first birthday unless breeding rights are given.
The buyer is strongly encouraged to attend obedience classes with the puppy and must provide proper socialization for the puppy.
The buyer agrees to have the puppy examined by a licensed veterinarian within (3) days of taking possession of the puppy. If the puppy is determined to be in poor health, as evidenced by a veterinarians written statement regarding the health of the puppy, the buyer may elect to keep the puppy, assuming all costs of the puppy's care, or may return the puppy for a full refund (transportation is the responsibility of the buyer). A veterinarian's written statement regarding the health of the puppy must be provided to the breeder at the time of return. This provision will expire 72 hours after the buyer takes possession of the puppy.
If the buyer can no longer take proper care of the puppy or can no longer keep the puppy, the buyer must either find a proper home for the puppy where proper veterinarian care, food, exercise, and companionship are provided or return the puppy to the breeder with no refund of the purchase price. Prior to returning the puppy to the seller, all vaccinations must be up to date and the puppy must be in good health.
BREEDERS GUARANTEES:
The breeder guarantees that the puppy is healthy, free from known contagious diseases, and has had vaccinations and worming appropriate for its age at the time of purchase.
The breeder guarantees that the puppy is free from genetic disorders that are life threatening or limiting during it's first year of life. Buyer must provide a statement from either OFA (hip / elbow / patella disorders), a Veterinary Ophthalmologist for eye disorders, or a University Clinic Veterinarian for other genetic disorders.
Options should the puppy have a genetic disorder that is life threatening or limiting.
1) Buyer may decide to keep the puppy, assuming all costs of care. Buyer must spay or neuter the puppy, and provide all Veterinarian documentation to the breeder. The breeder will then refund one half the purchase price of the puppy.
2) Buyer may return the puppy to the breeder (transportation is the responsibility of the buyer). The breeder will provide a replacement puppy of equal value within 12 months. Breeder reserves the right to have a Veterinarian of breeders choice examine the puppy to confirm the diagnosis. At this time the buyer must sign over all registration papers and health records the the breeder.
3) If the puppy must be put down due to the genetic defect, a written statement from two (2) licensed Veterinarians from tow (2) different clinics (one must be from a University Clinic) must be provided to the breeder stating that it was medically necessary to put the puppy down due to genetic disorders. The breeder will then replace the puppy with a puppy of equal value within 12 months. Buyer must return all registration papers and health records.
EXTENDED FIVE (5) YEAR HEALTH GUARANTEE:
Breeder believes that most disease is caused by what we are feeding our pets. all breeder's dogs and puppies are being fed a high quality, premium dog food, Life's Abundance dog/puppy food and NuVet Vitamins.
To take advantage of the 5 year health guarantee, buyer must maintain puppy on Life's Abundance dog/puppy food, and give NuVet Plus Vitamins daily. The Life's Abundance Wellness Supplement may be substituted for the NuVet Plus Vitamins. Puppy must also see the Veterinarian yearly for a health check, receive appropriate vaccinations by Veterinarian, stay on Veterinarian recommended worming and heartworm prevention. Buyer must provide adequate exercise (evidenced in proper weight control), provide clean water and provide a clean living environment for the puppy. This health guarantee does not cover infectious disease, parasites, poisonings, or accidents. It also will not cover any disease process caused by abuse or neglect.
Should the puppy become ill within the first 5 (five) years of its life - provided the above conditions are met, breeder will reimburse buyer 1/2 (one half) of the Veterinarian bills for the described illness, up to one half of the purchase price of the of the dog. This will not include well puppy checkups, vaccinations, or routine Veterinarian care.
The breeder makes no guarantee regarding the loss of the puppy due to accidental death, poisoning, theft, sickness, etc., or any other loss beyond the breeder's control, except as stated above.
If either the breeder or the buyer takes legal action regarding this contract, that action shall initiated in Citrus County, Florida.
For the 5 year health guarantee, buyer must buy Life's Abundance dog food and NuVet Plus Vitamins through the breeders website.
